"This member
[judiciary] of the Government was at
first considered as the most harmless and helpless of all its
organs. But it has proved that the power of declaring what the law
is, ad libitum, by sapping and mining slyly and without alarm
the foundations of the Constitution, can do what open force would
not dare to attempt."
--Thomas Jefferson to Edward
Livingston, 1825. ME 16:114
No Law at All
Disillusioned by
what we are not and what we have become after some 200 foreign
“incursions” and 200 years as a nation maybe telling. Sadly collective immoral
force and thought triumph daily despite the written law. The Milgram experiments (why did those Germans kill all those Jews and
subsequent book Obedience to Authority) in the 1960's and as
personal observations everywhere confirm most humans are immoral
even without seducements of money and power. Juries and judges
alike ignore not only the law but its very essence; morality. As
America cascades into the abyss of illegitimacy and the light goes
out on the beacon to humanity many of us watch in dismay, confused
why the population at large still doesn't understand the simplest of
precepts which would prevent their ultimate economic or corporeal
demise. Not only God but natural law demands thou shalt not lie,
thou shalt not steal, and thou shalt not kill because to do so creates an
absolute right of self-defense. It is suicide.
Attempting to legitimize an immoral
act is not, and can never be lawful.
It is a crime to
steal, to commit perjury, to extort because is threatens a person's
very existence. Regardless whether you are a
plantation owner or a government, slavery in any form and the force
necessary to extract benefit from living human beings against their
will is immoral and therefore unlawful. In America as elsewhere
apparently camouflaged slavery is still legal despite our
fundamental law, the Constitution. Trials today are no longer
conducted by the 800 year old precept of juries-of-peers but by
anyone off the street having never read our Constitution, knowing
nothing of their duty to judge the law; including the facts, nor
seemingly having given a thought to right and wrong. We have fallen
so far from morality that today American juries would surely convict
Jesus without remorse. No matter how you disguise a reprobate
whether clad in the floweriest rhetoric for the noblest of causes,
immoral acts, like theft by coercion or fraud, bearing false witness
by the standard of honesty and not candor, to deprive a sacred
living human being of the right of freedom, his right to use his
short time here on Earth to do as he sees fit by his own God given
free will, is absolutely repugnant.
Our "legal" system is broken and
corrupt when one can be fined, arrested, or indicted for neither
harming another human being nor damaging property. And what
standing do legal precedents have that are founded in immorality?
None. The application of precedents and
stare decisis in and of themselves are fundamentally immoral
for they ignore the reality that human beings and facts to a case
are always unique and they pervert fundamental law by elevating the
findings of a particular case e.g. "case law" above adherence to our
common law constitution or fundamental right and wrong. In essence these acts are no different, no
they are more
egregious
than treason for to ignore
fundamental law, having sworn to their protection and defense, is a
crime not only against Americans but humanity. These are
crimes not unlike a foster parent pedophile so egregious they are
almost incomprehensible. Precedent and stare decisis could never
exist if in fact a moral, lawful trial was adjudicated by a jury
because what jury would have a reason to know details of a prior
case? The jury is interested only in the instant case, as they
should be. It is not a “trial by judge” but a “trial by jury” of which
Americans brag. Trials by individual persons e.g. judges, have
always been known to be a farce and miscarriage of justice, and that
is why jury trials are mandated for any $20 infraction. The only legitimate duty of a
judge is to referee prosecutor and defendant not to manipulate the
out come of the trial by manipulating procedures and evidence. The
jury is supposed to conduct the trial and pass sentence, not the
judge.
In all human history there is not a
government which has not bled its population to the point of
rebellion because never has government and those who feed at its
illegitimate trough been able, like so many addicts, to resist their
escalating lust for greed and power. Unfortunately we have not yet
fashioned the tools necessary to keep government from turning upon
its citizen charges, unless
by good fortune the Judicial
Accountability Initiative Law is enacted requiring lawyers and
their counter parts in black dresses to adhere to the law.
Government's only legitimate role to protect the rights of a single
human being against others, has been trumped by a myriad of
illegitimate laws and lawyers condoned through judicial "misconduct"
and complicity fashioning a society legitimizing wrongdoing. But
before you single out the lawyers consider nearly every citizen,
through the unconstitutional financial system, is a complicit
criminal whether they wish to recognize their criminal behavior or
not. Our counterfeit money and credit is in the final analysis paid
in full by those who have no credit, the poor not only here but
abroad through inflation (the only source of which is printing
money). How do those without extraordinary profits retire when a
dollar is worth a nickel twenty years later? How is it that citizens
are forbidden to counterfeit but bankers can earn 45%+ interest on
money they don’t even have? I know how this helps the bankers, some
borrowers, and elite government officials, but how does theft
benefit society? We have jumped over the bridge hoping the bungee
cord won’t break falling ever closer to civil war and this time most
likely Armageddon. One is hard pressed to cite a single fundamental
provision of our Constitution that is in force today or any of the
precepts once considered fundamental to valid law. When God’s law
or our fundamental law is not understandable by the common man and
is considered open to interpretation it is no law at all. When
penalties exist where no person or property has been damaged then it
is no law at all. When rights are conferred by collective consent
they are not rights at all. When there is no legitimate law but
only force it is not long before rebellion is the only choice. The
people’s rules for governance, our Constitution, by declaration and
convention of the lawyers, is not worth the paper it is written on.
Noble in its intent our Constitution is for all intended purposes
now nearly wholly void except as a propaganda tool with which to
herd the population in most often illicit nationalistic pursuits
manifested as handouts to ourselves that our minders may exact an
ever-increasing commission. Somehow today's citizen can't draw the
simplest of connections between their survival and the fundamentals
of thou shalt not. It is one thing for the immoral majority to
ignore God’s law and natural law, it is however a death sentence,
when leaders and government legitimize the immoral.

[Art.] l0. [Right of Revolution.]
Government being instituted for the common benefit, protection, and
security, of the whole community, and not for the private interest
or emolument of any one man, family, or class of men; therefore,
whenever the ends of government are perverted, and public liberty
manifestly endangered, and all other means of redress are
ineffectual, the people may, and of right ought to reform the old,
or establish a new government. The doctrine of nonresistance
against arbitrary power, and oppression, is absurd, slavish, and
destructive of the good and happiness of mankind.
--New Hampshire Constitution (rightfully never amended) June 2,
l784
"To consider the judges as the
ultimate arbiters of all constitutional questions [is] a very
dangerous doctrine indeed, and one which would place us under the
despotism of an oligarchy. Our judges are as honest as other men and
not more so. They have with others the same passions for party, for
power, and the privilege of their corps. Their maxim is boni
judicis est ampliare jurisdictionem [good justice is broad
jurisdiction], and their power the more dangerous as they are in
office for life and not responsible, as the other functionaries are,
to the elective control. The Constitution has erected no such single
tribunal, knowing that to whatever hands confided, with the
corruptions of time and party, its members would become despots. It
has more wisely made all the departments co-equal and co-sovereign
within themselves."
--Thomas Jefferson to William C.
Jarvis, 1820. ME 15:277
"In denying the right [the Supreme
Court usurps] of exclusively explaining the Constitution, I go
further than [others] do, if I understand rightly [this] quotation
from the Federalist of an opinion that 'the judiciary is the
last resort in relation to the other departments of the
government, but not in relation to the rights of the parties to the
compact under which the judiciary is derived.' If this opinion be
sound, then indeed is our Constitution a complete felo de se
[act of suicide]. For intending to establish three departments,
coordinate and independent, that they might check and balance one
another, it has given, according to this opinion, to one of them
alone the right to prescribe rules for the government of the others,
and to that one, too, which is unelected by and independent of the
nation. For experience has already shown that the impeachment it has
provided is not even a scare-crow... The Constitution on this
hypothesis is a mere thing of wax in the hands of the judiciary,
which they may twist and shape into any form they please."
--Thomas Jefferson to Spencer
Roane, 1819. ME 15:212
"Don’t conclude
that you are a good person when in the face of wrong doing you say
or doing nothing to avoid potential personal harm but be rightfully
embarrassed as it smacks of complicity and all too soon evil will
prevail."
